EVENTS ORGANIZED BY FKC
4.1 All prices listed on the FKC website are final and typically do not include VAT, as Founders Kite Club LLC is a U.S.-based company. Unless explicitly stated, no VAT is applied to invoices. Participants are responsible for any taxes that may apply in their country of residence. All prices are shown in euros (€).
4.2 Registration for FKC events is managed via email and the official application form on our website. After submitting the application, each request is individually reviewed. If accepted, the participant receives a booking confirmation and invoice. The registration becomes binding once the booking confirmation has been sent.
4.3 Cancellation & Transfer Policy
Tickets may be transferred to another FKC event within the same calendar year, provided the request is made at least 60 days before the start of the original event. If there is a difference in event prices, the participant will either be credited or charged the difference.
Tickets canceled or transferred with less than 60 days’ notice are subject to a €500 administrative fee.
Unused tickets not transferred or claimed by the final event of the calendar year will be forfeited.
4.4 Payment is due via bank transfer on the due date stated on the invoice — typically two weeks after receiving the booking confirmation. All transfer fees must be covered by the participant.
4.5 If the date or location of an event changes, tickets generally remain valid. The event calendar is indicative and may be subject to updates, rescheduling, or cancellations. FKC will notify participants promptly of any changes.
4.6 In case of a rescheduled event, ticket holders may request a refund by a deadline set by FKC (usually shortly after the new date is announced). Tickets returned before the deadline will be refunded in full. After this period, no claims for reimbursement will be accepted.
4.7 Refunds are only possible if the original ticket is returned. When requesting a refund, participants must provide their bank account details. No refunds will be issued after the deadline. Additional claims (e.g., travel costs, accommodation, postage) are excluded.
4.8 No-shows are not eligible for any refund or compensation.
4.9 Tickets are non-transferable to another person and cannot be resold for commercial purposes.
4.10 Discounted tickets (e.g., early bird offers or partner discounts) are only valid when used by the original ticket holder and may require proof of eligibility at the event.
4.11 FKC reserves the right to decline or exclude any participant from an event. In such cases, any payments already made will be fully refunded.
RECORDING DURING FKC EVENTS
By attending FKC events, participants acknowledge and agree that audio, photo, and video recordings may be made during the event — including images of individual participants — at no cost to FKC.
Participants grant Founders Kite Club LLC the unrestricted right to use, reproduce, edit, and publish such recordings or any images submitted by participants, in any format and across any media, without time or geographic limitation.
This includes, but is not limited to:
Press and media publications
Event promotions and marketing materials
Posters, brochures, calendars, and manuals
FKC websites and social media channels
Third-party platforms such as YouTube, Vimeo, Instagram, Facebook, etc.
FKC may also share or license this content to third parties, with or without compensation, for promotional or editorial purposes.
If you do not wish to appear in such recordings, please inform the FKC team in writing prior to the event.
LIABILITY
6.1 Founders Kite Club LLC (FKC) is only liable for damages resulting from intentional misconduct or gross negligence by FKC, its legal representatives, or agents.
6.2 Nothing in these Terms limits or excludes FKC’s liability for death, personal injury, or harm to health caused by negligence. FKC is also liable for damages caused by the breach of essential contractual obligations — i.e., obligations that are fundamental to the execution of the agreement and which users may reasonably rely upon. In such cases, if the breach is due to ordinary negligence, liability is limited to foreseeable damages at the time of the event or service.
6.3 FKC is not liable for any further claims, including indirect, incidental, or consequential damages, unless otherwise required by law.
6.4 Force Majeure
FKC shall not be held liable for any delay or failure to perform its obligations under these Terms if such delay or failure is due to causes beyond its reasonable control, including but not limited to: natural disasters, pandemics, government restrictions, wars, strikes, supply chain disruptions, extreme weather, or interruptions of internet or utility services. In such cases, FKC reserves the right to reschedule, modify, or cancel events without obligation to provide compensation beyond applicable refund terms set forth in Section 4.
MEMBERSHIP
7.1 Membership with Founders Kite Club is structured as an annual subscription, priced at €300 per year.
7.2 The subscription becomes active on the date of purchase and automatically renews every 12 months on the same date, unless cancelled in accordance with these Terms.
7.3 Membership grants access to exclusive pricing, special offers, and discounts on event tickets. Membership is required to access these benefits and preferential rates.
7.4 To cancel the membership and avoid renewal, members must do so before the renewal date. Once the membership has been renewed, it cannot be cancelled or refunded for that period.
7.5 All membership fees are non-refundable once the subscription has been renewed.
7.6 Founders Kite Club reserves the right to revoke or refuse membership for just cause. In such cases, a refund may be issued at FKC’s discretion.
MISCELLANEOUS
8.1 These Terms and any contractual relationship with Founders Kite Club LLC are governed exclusively by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles.
8.2 Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the state or federal courts located in Sheridan County, Wyoming, to the extent permitted by applicable law.
